Purpose
and Application:
The purpose of this Act is to impose
certain obligations over those individuals and entities that
collect personal information or data. It will apply to
any person or entity that collects information either
offline (such as entry coupons or mail entries) or online
(such as personal data for registration, online surveys,
contests or sweepstakes). Among various other
obligations imposed, the Act imposes the obligation to have
and to disclose a privacy policy that specifies the
information being collected and uses intended for the same
including the process by which a Puerto Rico resident shall
be able to amend or modify such data and uses.
Effectiveness:
The obligations under this law will
commence 120 days from the date on which a Regulation to
implement this law is enacted by the Secretary of Consumers'
affairs (DACO).
Recommendation/Tip:
Any person or entity that collects
personal information (as defined by the Act), from Puerto
Rico residents should start making preparations at once for
implementation at any time after June 30, 2012.
Penalties:
The penalty for non-compliance is up to
$50,000.00 in addition to any remedy before a civil court.
